Terms of Service
2.1 Acceptance of Terms

2.2 Scope of Services
ArqentaDigitalStudio provides UI/UX design, web design, mobile interface design, prototyping, design system creation, landing page design, product redesign, and accessibility audit services. The specific scope, deliverables, timeline, and pricing for each project are defined in individual service agreements or proposals issued prior to project commencement.
2.3 Quotations and Pricing
All prices listed on this website are indicative and denominated in Euros (EUR). Formal quotations are provided after an initial discovery consultation and are valid for 30 days from the date of issue. ArqentaDigitalStudio reserves the right to adjust pricing for projects whose scope changes materially after the initial agreement.
2.4 Payment Terms
- A 50% deposit is required before project commencement for all services exceeding EUR 500.
- The remaining 50% is due upon delivery of final assets, prior to handover of source files.
- Invoices are payable within 14 calendar days of issue.
- Late payments incur a statutory interest rate of 4% per annum under Portuguese civil law.
2.5 Project Timeline and Delays
Estimated timelines are provided in good faith and commence upon receipt of the deposit and all required client materials. Delays in providing feedback, assets, or approvals may extend the delivery timeline proportionally. ArqentaDigitalStudio will communicate any anticipated delays promptly.
2.6 Intellectual Property
Upon full payment, ArqentaDigitalStudio assigns to the client all intellectual property rights to the final delivered work product, including designs, mockups, and source files. ArqentaDigitalStudio retains the right to display completed work in its portfolio and marketing materials unless otherwise agreed in writing.
2.7 Client Responsibilities
The client agrees to:
- Provide accurate and complete project briefs, brand guidelines, and required assets in a timely manner.
- Designate a single point of contact for all project communications.
- Review and approve deliverables within 7 business days of submission.
- Ensure all content provided does not infringe upon third-party intellectual property rights.
2.8 Limitation of Liability
ArqentaDigitalStudio shall not be liable for indirect, incidental, consequential, or punitive damages. Our total aggregate liability under any service agreement shall not exceed the total fees paid by the client under that agreement.
2.9 Confidentiality
Both parties agree to maintain the confidentiality of proprietary information exchanged during the course of a project. This obligation survives the termination of the service agreement for a period of 24 months.
2.10 Governing Law
These Terms of Service are governed by and construed in accordance with the laws of the Portuguese Republic. Any disputes arising from or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of Sintra, Portugal.
2.11 Amendments
ArqentaDigitalStudio reserves the right to amend these Terms of Service at any time. Material changes will be communicated via email or a prominent notice on this website at least 14 days before taking effect.
Refund Policy
4.1 General Refund Terms
ArqentaDigitalStudio is committed to delivering high-quality design services. Due to the nature of digital design work, refund terms are structured to account for the time, expertise, and resources allocated to each project.
4.2 Pre-Project Cancellation
- Cancellation before project commencement: Full refund of any deposit paid, within 14 business days.
- Cancellation within 48 hours of project commencement: 75% refund of the deposit.
- No refund is available for cancellation requests received more than 48 hours after project commencement.
4.3 In-Progress Projects
For projects cancelled after work has commenced, the client is entitled to a refund of the portion of fees corresponding to work not yet completed, minus any non-recoverable costs incurred by ArqentaDigitalStudio. The refund calculation is based on a fair assessment of completed milestones versus the total project scope.
4.4 Delivered Work
Once final deliverables have been provided and accepted by the client, no refund is available. If the delivered work materially deviates from the agreed specifications in the approved project brief, the client must notify ArqentaDigitalStudio within 7 business days of delivery to request a revision at no additional cost.
4.5 Revision Policy
- All projects include up to two rounds of revisions at no additional cost.
- Additional revision rounds are billed at EUR 75 per round.
- Revisions must be requested within 14 days of each delivery milestone.
4.6 Non-Refundable Items
The following are non-refundable:
- Third-party costs incurred on behalf of the client (stock imagery, font licences, hosting fees, domain registrations).
- Work completed under a separate written agreement or addendum.
- Services rendered beyond the scope of the original project brief, where additional work was authorised in writing.
4.7 Refund Process
Refund requests must be submitted in writing to [email protected] with the subject line "Refund Request — [Project Name]". Requests are reviewed within 5 business days, and approved refunds are processed within 14 business days via the original payment method.
4.8 Dispute Resolution
In the event of a dispute regarding refunds, both parties agree to attempt resolution through good-faith negotiation before pursuing any legal remedy. Disputes that cannot be resolved amicably shall be subject to the jurisdiction of the courts of Sintra, Portugal, in accordance with Portuguese law.
